The fact that the Z is a sports car and the 5.0 is one too (although it is arguable in my book), the natural inclination one would have to race would be high. However, the Z owner did not take the bait. Rather, he slowed down. The cop obviously was pissed for the sole fact that their idea did not work. In fact, the Z driver actaully slowed down!

Had the Z driver engaged in a race, it would have been on the original act of the officer in the 5.0 trying to start a race. That my friend is entrapment. If the law leads you to do something you wouldn't normally do without their input, especially illegal, it is entrapment. Think of it this way, if the guy in the 5.0 wasn't there, do you think the Z owner would just decide to floor it there?

Granted, what inspires someone to gun it at any particular moment over another is difficult to determine. But without someone to race there is no race, which is what the charge would have been for had he engaged in the race with the 5.0.

The driving pattern the guy in the 5.0 was demonstrating sounds pure and simple like "lets race" manuvers. Not only that, but the fact that it was a cop driving it and his buddy was parked down the road ready to pull him over doesn't make their case look good at all. This is an awesome example of entrapment. Reread the original story and maybe crack open a few textbooks to study this more, but you will find that all the conditions are met and even exceeded.

: i remember this specifically from this past semester, since something very similar was brought up. what i posted before about it, was what was said. the guy in the mustang did not make him speed, or really encourage it in any way, all he was doing was driving like an ass, that does NOT entrap cant_z_me to do anything out of the ordinary. what he did was totally voluntary. its really that simple. im not defending what the cops did, that was pretty fucked up, and that is one reason why the police really piss me off, for stupid shit like that. im sure they could have found something better to waste their time on. but i still hold my position saying this is not entrapment, id like to know the result of it after it has been taken to court, just for the sake of knowing what the judges decision was.
